In a letter dated December 9, 2019, the two-year-old Kudlu-based Karnataka RTI Workers Seva Samithi (KRTIWSS) has complained to the chief secretary of Karnataka to take action on BBMP offices in Begur Road and HSR Layout for not providing information about building violations in their jurisdiction as mandated by the Right to Information Act, 2005. The BBMP was to answer the queries within 30-45 days, but the civic agency failed to do it even after 79 days and counting.

In the last two years, over 40 RTI queries were made to the Bommanahalli BBMP office, however, the replies were never satisfactory. “They would give vague information, or never respond at all, or quote one fake RTI circular that a person can only file a query only three times a year,” said Vijay Dennis, the founder of the KRTIWSS.

Some of the complaints by KRTIWSS had to do with footpath encroachments across HSR Layout and Begur Road, and rampant building violations on stormwater drains, among other things. They have also filed a complaint with the Lok Ayukta about footpath encroachments by commercial establishments in HSR Layout.

“The BBMP officials just issue the showcause notice to the accused, take bribe and keep quiet without taking any action,” alleged Dennis. “Even if one building is demolished, the others will get scared, and not make the same mistake.” His fight continues. Will the authorities respond remains to be seen.

When you pay well, your employees should be happy. However, if you set up a new firm and siphon off all the business from the company that employed you to the firm that you set up, it becomes a fraudulent activity. And that’s what has happened in HSR Layout recently.

Real estate dealer Pruthvi Raj Batra (57), a resident of Sector 6, is the affected party due to the alleged fraud committed by his employees, Abhishek Gupta (29), a resident of Sector 7, and Himanshu Mitra Agarwal (38), a resident of Iblur.

The complaint states that the two accused were employed with Batra’s Delhi-based firm, Buniyad Retail India’s Bangalore branch. They were in charge of the unit and being given the salary and other benefits by Batra’s firm. However, unknown to Batra, the accused set up their own apartment sales company and transacted all the real estate deals by diverting Batra’s clients to their firm. This way, the complaint alleges that they cheated Batra’s company worth lakhs.

The HSR Layout police have charged the accused for criminal breach of trust and are investigating.

On June 19, a labourer died a horrible death on 23rd Cross off 24th Main in Sector 2, HSR Layout. The incident occurred at an under construction building around 12.40pm and the police complaint was lodged the same day at 4.30pm.

The building was coming up on plot number 275. On June 19, at around 9am, building contractor Gopi took 22-year-old labourer Maruthi to Venkatesh, the house owner. The proprietor apparently asked Maruthi to do the plastering work on the fourth floor along with Maruthi’s elder brother Gangareddy and younger brother Anjaneya.

However, Anjaneya fell from the fourth floor while plastering and was immediately rushed to NH Narayana Hospital in Sector 3 for emergency treatment. However, the injury was too grievous and the labourer died.

A case of death by negligence is registered against Venkatesh and Gopi as no helmet or safety belt was provided to the labourers for the plastering work during the construction. And neither was a net used to protect accidental falls. This showed callousness on the part of the building contractor and house owner, according to complainant Maruthi. For this offence, if convicted, the accused could be in jail for two years or with fine or both.

This is a serious issue as many building constructions in residential areas don’t follow these safety parameters. Only when someone dies do we wake up to realise the wrongs we have done and snuffed out the lives of innocents. It’s time all the house owners and building contractors ensured that all safety precautions are taken while a structure is being erected.
